HAMILTON COUNTY MUNICIPAL COURT
Civil Mediation:
Mediation of civil cases is available through the Municipal Court's
Private Complaint Mediation
Service:
-
Mediation may be utilized in any civil case filed in Municipal Court, if all the
parties in the case agree.
-
A standard entry is used for referring cases from
a judge or magistrate to Private Complaint. Upon referral, the case should be
continued for 60 days on the Court's calendar, see
ENTRY AND REFERRAL TO MEDIATION.

-
The case will be sent by the clerk to Private
Complaint. The jacket will remain with the clerk and Private Complaint staff
will access the file through the Internet.
-
If mediation is successful,
Private Complaint staff will draft a settlement agreement for the appropriate
parties to sign. After mediation, Private Complaint will refer the case back to
the clerk for either dismissal or further proceedings before the Court, see
CONDITIONAL ENTRY OF
DISMISSAL. (PDF version)
-
If a party to the settlement agreement does not
fulfill such party's obligations under the agreement, a motion to enforce
the agreement may be filed for the Court's consideration, see
MOTION TO ENFORCE SETTLEMENT
AGREEMENT. (PDF
