from S.D. Ohio)

- Jermer sued for wrongful discharge in violation of public policy, alleging
retaliation for complaining about air quality at his employer's plant.
District court awarded summary judgment to Siemens. Affirmed.
- Parks v. City of Columbus (January 25, 2005) (appeal from S. D. Ohio)

- Parks appealed district court denial of declaratory and injunctive relief
involving free speech. Reversed, finding that the city "applied a
regulation in such a way that restricts the freedom of speech of one of its
citizens", and remanded with directions to enter judgment for Parks and for
consideration of damages.
- Richey v. Mitchell (January 25, 2005) (appeal from N.D. Ohio)

- Richey was sentenced to death and petitioned for writ of habeas corpus
after appeals in Ohio state courts failed. District court denied
request. Reversed, finding that constitutional errors - Richey's
conviction lacked support of sufficient evidence, that claims were preserved,
and ineffective counsel - undermined reliability of conviction and sentence.
