Caseer paid to have 50 khat plants brought into the U.S. from the Netherlands and his courier was stopped by drug enforcement agents on his return.  Caseer was arrested and charged with conspiracy to import and importation of cathinone, a controlled substance.  Caseer was convicted at a bench trial and appealed the conviction, because he did not have warning that the khat contained a controlled substance.  Reversed, and remanded, because of fair-warning doctrine and sufficiency of evidence.
