McMillan was an attorney for the EEOC, and filed suit against her employer alleging Title VII gender discrimination and violation of the Equal Pay Act. A jury found for the Commission on the Title VII claims and the judge found for the Commission on the wage claims. McMillan appealed, arguing a hostile judge tainted the fairness of her case.  Affirmed, although judge's comments are troubling, they did not create judicial hostility or bias; "similarly situated" does not always mean that the employees must report to the same supervisor
