Kovacs v. Chesley (May 2, 2005) (Appeal from S.D. Ohio)

Kovacs sued Chesley for legal malpractice, arguing that he failed to review her medical records carefully and submitted her into the wrong class of claimants in a breast implant class action, and she received less than she might have. The district court dismissed, finding that, because the amount in controversy was less than $75,000, it did not have subject-matter jurisdiction. Reversed, because plaintiff alleged amount greater than $75,000, there is a legal basis for her claim, and she has some chance to recover the amount.

Vershish v. United States Parole Comm'n (May 2, 2005) (Appeal from W.D. Tenn.)

Vershish was paroled after being convicted, and broke parole. He was arrested based on his parole violations, and sought a revocation hearing since he'd been arrested under a warrant. The Commission thought the warrant had not be executed, but that it had been lodged as a detainer. Vershish petitioned for a writ of habeas corpus, which was denied by the district court. Vacated and remanded, directing the district court to conditionally grant the writ.
