What is Mediation? Mediation is a process in which a neutral party (the mediator) helps disputing parties negotiate a mutually acceptable settlement to their dispute. The mediator's role in the hearing is to facilitate the negotiation process; the mediator does not impose settlements, issue orders or make judgments. In the hearing, the mediator gives each party an opportunity to present his or her side of the dispute and asks each to offer opinions about acceptable solutions. The mediator helps the parties reach a settlement that is workable, specific and satisfactory to both. |
